Storqube Terms of Service
1. Acceptance of Terms
By accessing or using Storqube ("Service"), operated by Forge Stack LLC ("Company", "we", "us", or "our"), you ("User", "you", or "your") agree to be bound by these Terms of Service. If you do not agree, do not use the Service.
2. Description of Service
Storqube is a cloud-based platform designed to support storage-related businesses, including but not limited to facility management, unit tracking, tenant management, billing, payments, reporting, and related operations.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.
3. User Responsibilities
You agree to:
* Provide accurate and complete information
* Maintain the security of your account credentials
* Use the Service in compliance with all applicable laws and regulations
* Ensure that all tenant, customer, and business data entered into the Service is accurate and lawful
* Not misuse, disrupt, or attempt unauthorized access to the Service
You are solely responsible for all activity that occurs under your account.
4. Payments and Billing
The Service may allow you to manage billing, invoices, and payment collection.
We are not a bank, payment processor, or financial institution.
All payments are processed through third-party providers. We do not hold or control funds.
You are solely responsible for:
* Setting rates, fees, and billing rules
* Ensuring proper authorization for charges
* Handling disputes, refunds, and chargebacks
* Compliance with all applicable financial and tax regulations
We are not liable for payment failures, delays, fraud, chargebacks, or financial losses of any kind.
5. Tenant and Customer Management
You are solely responsible for your relationships with your tenants or customers.
We do not:
* Act as a landlord, property manager, or agent
* Enforce rental agreements
* Handle disputes between you and your tenants
Any agreements, disputes, or claims between you and your tenants are your sole responsibility.
6. Third-Party Services
The Service may integrate with third-party providers, including payment processors, access control systems, messaging platforms, and analytics tools.
We are not responsible for the availability, performance, or accuracy of third-party services.
Your use of such services is at your own risk and subject to their terms.
7. Data and Content
You retain ownership of all data and content you submit to the Service.
You grant us a non-exclusive, worldwide, royalty-free license to use, host, store, and process your data solely for the purpose of providing the Service.
You are solely responsible for the legality, accuracy, and integrity of your data.
8. Service Availability
We do not guarantee that the Service will be uninterrupted, secure, or error-free.
We are not responsible for outages, delays, data loss, or interruptions, including those caused by third-party infrastructure or services.
9. Limitation of Liability
To the maximum extent permitted by law, Storqube and its owners, employees, contractors, and affiliates shall not be liable for any direct, indirect, incidental, consequential, special, or punitive damages, including but not limited to:
* Loss of revenue
* Loss of profits
* Loss of data
* Loss of tenants or customers
* Missed payments or billing errors
* Property-related disputes or damages
* Business interruption
* Reputational damage
This limitation applies regardless of the cause of action, whether in contract, tort, negligence, or otherwise, even if we have been advised of the possibility of such damages.
10. No Warranty
The Service is provided "as is" and "as available" without warranties of any kind, express or implied.
We disclaim all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement.
11. Indemnification
You agree to indemnify, defend, and hold harmless Storqube and its owners, employees, contractors, and affiliates from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising out of:
* Your use of the Service
* Your business operations
* Your relationships with tenants or customers
* Your violation of these Terms
* Your violation of any law or third-party rights
12. Account Termination
We reserve the right to suspend or terminate your account at any time, with or without notice, for any reason.
You may cancel your account at any time.
Upon termination, your access to the Service may be revoked immediately, and we may delete your data without liability.
13. Data Loss and Backup
You acknowledge that you are solely responsible for maintaining backups of your data.
We are not liable for any loss, corruption, or recovery of data.
14. Acceptable Use
You agree not to use the Service to:
* Engage in illegal or fraudulent activity
* Misrepresent rental terms or tenant agreements
* Upload harmful or malicious content
* Attempt to exploit or interfere with the Service
We reserve the right to remove content or suspend accounts that violate this section.
15. Force Majeure
We are not liable for failure or delay in performance due to causes beyond our reasonable control, including but not limited to acts of God, natural disasters, internet outages, cyberattacks, or government actions.
16. Changes to Terms
We reserve the right to update or modify these Terms at any time.
Continued use of the Service after changes constitutes acceptance of the updated Terms.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Alabama, without regard to conflict of law principles.
18. Entire Agreement
These Terms constitute the entire agreement between you and Storqube regarding the use of the Service and supersede any prior agreements.
